ABUVIÇE TOURISM AND TRAVEL AGENCYDOMESTIC PACKAGE TOUR AGREEMENT

PARTIES

This contract;

AbuViçe Tourism and Travel Agency (EKIN DANIŞMANLIK TURIZM VE ORGANIZASYON HIZMETLERI A.Ş.) based in Rize (hereinafter referred to as "Agency")

with

The participant who registered for the tour and whose information is included in the reservation form (hereinafter referred to as "Guest")

between;

It was concluded within the framework of the provisions of the Consumer Protection Law No. 6502, the Travel Agencies Law No. 1618 and the Package Tour Contracts Regulation.

Agreement;

Voucher, brochure, preliminary information form and tour program are integral parts of this contract.

SUBJECT OF THE CONTRACT

SCOPE OF SERVICE AND AGENCY'S OBLIGATIONS

Agency;

Program Change

Provided that the tour content and quality do not change;

• Traffic

• Official regulations

• Operational imperatives

The day and visit order of the program may be changed due to this reason.

These changes do not give rise to a right to compensation.

MINIMUM PARTICIPANT REQUIREMENT

If the minimum number of participants required to organize the tour is not reached, the Agency reserves the right to cancel the tour.

This situation is notified to the Guest at least 3 days before the start of the tour.

The entire amount paid will be refunded.

FORCE MAJEURE (EXTRAORDINARY SITUATIONS)

The following situations are considered force majeure:

• natural disasters

• epidemic diseases

• Official bans

• Security risks

• road closures

• weather conditions

• Decisions of public authorities

In these cases;

• Program can be changed

• The tour may be postponed

• Tour may be canceled

In these cases, the Agency is not considered at fault.

In case of cancellation, only the unrealized service fee will be refunded.

PAYMENT TERMS

• The reservation is finalized upon payment of the tour fee.

• The full tour fee must be paid before the start of the tour.

• If payment is not made, the Agency may cancel the reservation.

SEAT ARRANGEMENT

• Vehicle seat placement is determined according to the order of reservation and payment.

• Guests who complete their reservation and payment first have priority to sit in the front seats.

• Seat numbers are determined before the start of the tour.

• Seat changes cannot be made during the tour.

• The seating arrangement cannot be changed except for operational requirements.

GUEST'S OBLIGATIONS

Guest;

• You have read and accepted the program

• Your health condition is suitable for the tour

• He/she will comply with the warnings of the guide and authorities.

• He/she will not engage in any behavior that would disrupt the tour order.

In case of behavior that disrupts the tour order, the Guest may be removed from the tour.

In this case, no refund will be made.

Non-program personal expenses are the responsibility of the Guest.

CANCELLATION AND TRANSFER CONDITIONS (DOMESTIC)

Transfer

The guest may transfer the package tour contract, together with all its rights and obligations, to a third party, provided that he gives written notice at least 7 days before the start of the tour.

Cancel

• Up to 30 days before: For cancellations made up to 30 days before the start of the tour;

• For cancellations made 29-15 days in advance: 50% of the total tour price will be deducted.

• For cancellations made 14 days or less in advance: The full tour fee will be charged and no refund will be made.

LUGGAGE AND GOODS RESPONSIBILITY

• Guest;

• The agency is not under any obligation to pay compensation based on the material or moral value of the goods declared by the guest.

• Agency;

• Valuable items (cash, jewelry, electronic devices, passport, etc.) are the personal responsibility of the guest and must be carried with them.

• Even if the agency's gross negligence is proven clearly and in writing, liability is limited to only the part of the tour price that corresponds to transportation.

• The cost of transportation;

• This amount cannot in any way exceed the total cost of the tour.

PRICE CHANGE

Tour price;

• The Guest will be notified in writing of the price increase at least 20 days before the start of the tour.

• The rate of price increase is limited to the corresponding cost increase.

• If the guest does not accept the price increase, he can terminate the contract within 3 days from the date of written notification.

• In this case, the amount paid by the Guest is refunded after deducting the non-refundable service fees.

• If a notice of termination is not made within the prescribed period, the price increase is deemed to have been accepted.

INSURANCE

All guests are covered by compulsory package tour insurance in accordance with Law No. 1618.

This insurance;

• Bankruptcy of the agency

• Failure to provide service

covers situations.

Personal medical expenses are not covered by insurance.

HEALTH, SAFETY AND PERSONAL RESPONSIBILITY

• The guest accepts that his health condition is suitable for participation in the tour program.

• Special conditions such as bee allergy, chronic disease, regular medication use must be reported at the reservation stage.

• Access to healthcare facilities may be limited in plateau and rural areas.

• The guest is obliged to keep the medications he uses regularly with him.

• The agency does not provide or distribute medication during the tour.

• Basic dressings and bandages can only be applied to simple injuries.

• In cases requiring medical intervention, the responsibility belongs to the guest.

• Risks arising from natural conditions, insect bites, weather conditions or personal health are the responsibility of the guest.

• The agency is not responsible for any health-related damages except for gross negligence.

KVKK AND VISUAL SHARING

• Guest's personal data is processed, stored and protected within the scope of Personal Data Protection Law No. 6698 ("KVKK").

• Photos and videos can be taken during the tour.

• Explicit consent of the Guest is obtained for the use of video and audio recordings for promotional purposes.

• The Agency can show the relevant images to the Guest and also obtain approval before sharing;

• The guest has the right to withdraw his/her express consent in writing.

• Unless the guest gives explicit consent, their images will not be used for promotional purposes;

• Individual close-up shots may not be used for commercial purposes without express consent.

DISPUTES AND JURISDICTION

The legislation of the Republic of Türkiye shall apply to any disputes that may arise from this agreement.

In accordance with the provisions of the Consumer Protection Law No. 6502;

Consumer Arbitration Committees and Consumer Courts are authorized depending on the amount of the dispute.

The competent place is Rize, the Guest's place of residence or the place of execution of the contract.

SPECIAL PROVISIONS ON HIGH ALTITUDE AND PLATEAUS ROUTES

• High altitude plateau and mountain routes included in the tour program;

• Plateau roads are narrow, winding and high-altitude mountain roads.

• Guests with altitude sensitivity, blood pressure, heart disease, panic attacks, respiratory problems or similar health problems are obliged to inform the Agency of their situation at the reservation stage.

• Guide due to air and road safety, operational obligations or security reasons;

• If the participant leaves the program individually based on his/her personal preference, the general flow of the program does not change.

• The Agency is not responsible for any adverse events arising from high altitude, natural conditions, road conditions or personal health, except for the gross fault of the Agency.

MEETING, DELAY, ACCOMMODATION AND OPERATIONAL PRACTICE PROVISIONS

1. Meeting and Delay

• It is the Guest's responsibility to be present at the meeting time and point specified in the tour program.

• The tour program will not be delayed due to guests not being present at the specified time or arriving late.

• If the guest cannot participate in the tour due to a delay caused by the guest's own fault, no refund will be made.

• Incorrect transportation planning, traffic, individual delay, missed flight or similar reasons are the responsibility of the Guest.

2. Program Flow and Sequence Change

• The day and order of the visit points specified in the tour program can be changed by the guide.

• This change does not give rise to the right to compensation as long as it does not harm the essence and quality of the program.

3. Accommodation Change

• The hotels and facilities mentioned in the program are exemplary.

• In case of operational necessity, availability or force majeure, the Agency has the right to change the accommodation facility of the same standard or higher category.

• This change does not entitle the Guest to a refund or compensation.

• Preferences such as room location, floor, view are not guaranteed.

4. Partial Participation and Early Withdrawal

• The guest may voluntarily choose not to participate in any activity in the tour program.

• He cannot request a refund for a service he did not attend.

• Guests who voluntarily leave the tour early cannot request a refund for unused services.

• Additional transportation and organization expenses that may occur in case of early departure belong to the Guest.

ACCOMODATION AND SERVICE CHANGES

• The hotels mentioned in the program are exemplary.

• In cases of necessity, changes can be made to a facility of an equivalent or higher category.

• Room features (view, floor, balcony, etc.) are not guaranteed.

• These changes do not entitle you to a refund or compensation.

ACCOMMODATION ARRANGEMENT AND ROOM SHARING

• The tour price is calculated on a twin basis.

• For guests requesting single accommodation, a single supplement will be applied.

• If there is an odd number of participants, room sharing may not be possible.

• Triple room option may be offered subject to facility availability and guest approval.

• Room distribution is at the discretion of the organizer company in line with operational requirements.
